The Role: Legal Counsel, Immigration (US/CAN)

As an experienced US Immigration Counsel, you will guide companies through the complexities of managing a globally mobile workforce. Deel’s immigration team assists companies and their employees in obtaining appropriate work authorization in the United States and navigating the nonimmigrant to immigrant visa process. Our comprehensive U.S. business immigration services include securing both immigrant (green card) and non-immigrant status (temporary work visas), alongside providing a range of U.S. immigration advisory services for employees and their employers.

Specific Responsibilities

  • Provide consistent, industry-leading legal support and strategy, including consular assistance, from initial consultation through petition filing.
  • Direct, review, provide feedback on, and approve the compilation and assembly of initial submissions, re-submissions, and RFE/NOID responses by Immigration Specialists.
  • Support and guide Company Immigration Specialists.
  • Assist the Company Sales team by offering legal consultations to prospects on strategy, timelines, and immigration options.
  • Actively contribute to process improvement and templating to expand Deel’s product offerings.
  • Draft petitions for new case types as needed.
  • Collaborate with Company Product and Engineering teams to enhance technology supporting the mobility team.
  • Stay current on changes in immigration laws, policies, and procedures, ensuring the immigration team is continuously updated.
  • Conduct training sessions for internal teams on legal developments and best practices in business immigration.

Skills and Attributes

  • Apply expert technical legal and procedural knowledge of U.S. business immigration law, including NIV, IV law, and consular support, to client situations.
  • Prepare, review, and submit non-immigrant and immigrant applications efficiently in a high-volume environment.
  • Manage client deliverables and expectations effectively, demonstrating an ability to prioritize competing tasks.
  • Facilitate the legal movement of employees across borders for business travel.
  • Cultivate relationships with other attorneys, law clerks, and client service team members.
  • Actively contribute to implementing best practices within our US immigration practice.

Qualifications And Requirements

  • JD along with admission to any U.S. state bar.
  • Minimum 3–5 years of U.S. business immigration experience, with a strong focus on high-volume filings, including E-2, O1, TN, E-3, EB-1, and EB-2 IV filings.
  • Ability to prepare and file high volume H1B and L1 (including blanket L1) petitions for corporate clients.
  • Advise corporate clients on all aspects of the PERM Labor Certification process.
  • Prepare and file PERM applications (ETA 9089) with the U.S. Department of Labor (DOL).
  • Oversee and manage the entire PERM recruitment process, including drafting and placing job orders and advertisements, reviewing and documenting recruitment results, and ensuring full compliance with DOL regulations and timelines.
  • Prepare audit responses and supervise supervised recruitment processes if needed.
  • Draft and file Form I-140 petitions in the EB-2 and EB-3 immigrant visa categories.
  • Excellent managerial, organizational, and verbal/written communication skills.
  • Ability to provide technical legal expertise and proactive, strategic business solutions aligned with client needs.
  • Ability to secure malpractice insurance.
  • The ability to work independently in a fast-paced, dynamic, team-oriented environment.
  • Ability to multi-task and manage a variety of projects.
  • High level of professionalism in handling sensitive and confidential information.
  • Technology proficiency.
